Legal Bases of the GIVEAWAY “A pack of Paymani creams + 1 mini fridge”
Identification of the organizing companyThe person Verónica Azcárate Ostolaza, representative of the Paymani Cosmética Cientifica Natural brand (hereinafter “Paymani”), with tax address at Calle Velero, 4, P-9 in Alicante and with DNI 44130076E, has organized this campaign titled "GIVEAWAY A pack of Paymani creams + 1 mini fridge" .
Start and end dates of the contest and geographical scope
The start date of the draw will be JULY 3 , 2023 at 0:00 a.m. and will end on AUGUST 4, 2023 at 9:00 a.m. You can participate only in that period of time. The campaign is aimed at users from any country in the European Economic Community. Paymani reserves the right to postpone or extend the draw period in case of force majeure, as well as the power to interpret these legal terms and conditions.
Rules and conditions to participate
Those individuals over 18 years of age residing in any country of the EEC may participate in the draw. Paymani employees or family members up to the first degree may not participate. The participation of fraudulent or non-real profiles will also not be allowed. To participate you must register in the draw using your real name, without surnames, and a valid email address. Paymani reserves the right to make changes to the campaign during its development, if any cause occurs that prevents it from being brought to a successful conclusion or in order to improve its progress.
Winner selection and draw mode
The draw will be held on August 4 at 9:00 a.m. through a web platform for random selection of participants. Participants will be uploaded to this platform using a unique numerical ID, keeping personal data protected at all times. Three (3) winning IDs will be selected from among the participants. After verifying the correlation of the winners' ID with the participants' data, they will be officially announced on our Facebook page, Instagram profile and they must contact us providing their information to send the prize. If any of them has not responded within 5 calendar days, the prize will go to the substitute, who will also have 5 calendar days to respond. Once the prize is offered to the alternate, the previous winner will lose the right to claim the prize. Paymani is exempt from any responsibility in the event of any error in the data provided by the winners/substitutes that prevents their identification.
Value and nature of the prize offered
The prize will be Abundance Cream (30g), Natural Rich Cream (30g), Royal Cream (150g) and a mini fridge for cosmetic use. Paymani is not responsible for possible losses, damage, theft or any other circumstance attributable to courier services.
Personal data protection
The data provided by the participants will be treated confidentially and compiled in an automated personal data file, with Paymani being the owner and responsible for said file, with the aim of:
• Manage the participation of those registered and contact them.
• Communicate that they have been winners of the contest.
• Send Paymani commercial information.
Paymani guarantees full compliance with Organic Law 15/1999, of December 13, Protection of Personal Data and the General Data Protection Regulation (RGPD) of the European Union, in the processing of personal data collected in the “Goodbye, Dry Skin Sweepstakes” contest, especially with regard to the attention to the exercise of the rights of information, access, rectification, opposition and cancellation of personal data of the participants.
Penalties in case of fraudulent use
We will understand as fraud the use of independent platforms or applications to obtain more entries in the contest, as well as behaviors that we detect as apparently abusive and/or malicious. The verification of any of these practices will mean the disqualification of the draw and the cancellation of the votes or participations that we consider have arrived through means that are not permitted in the campaign. Paymani reserves the right to take legal action against those who carry out any type of act that could be considered manipulation or falsification of the contest.
Paymani is exempt from any liability for damages that may be due to the temporary lack of availability or continuity of the operation of the application through which the promotion is participated, to the fraud of the utility that users could have attributed to the itself and access to the different pages and submission of participation responses through the Internet.
This contest is not linked to any platform or social network. Facebook and Instagram do not sponsor, endorse, or administer this promotion in any way, nor are they associated with it. Any manifestation of non-acceptance of all or part of the legal bases will imply the exclusion of the participant and, as a consequence, Paymani will be released from compliance with the obligation contracted with this participant.
